Terms of Use

The Websites (as defined underneath) are owned and operated by POAD Group Limited (“POAD”) and include any social media pages administered by POAD like those on Facebook, YouTube (“Social Media Sites”), etc. As POAD does not own the Social Media Sites, the use of those sites will also be subject to the terms and conditions of the site owners.

1. Terms

By accessing the Websites you agree to abide by and comply with all the terms and conditions contained in this Terms of Use and in the Websites (“the Terms”). POAD may vary, in its absolute discretion, the Terms at any time, and you should check from time to time for any changes.

2. Access and Link

You may access the Websites directly or you may be directed to the Websites through a link from an advertisement displayed by POAD (including via the use of mobile technology) or through a third party website.

Your use of and access to third party websites may be subject to additional terms and conditions as determined by those website owners and POAD is not responsible for nor does it endorse the contents of third party websites.

3. Intellectual Property

All information, text, images, graphics, software and advertisements contained in the Websites are protected by the laws of Hong Kong. The information in the Websites is presented for information only and you are not permitted to download any material except when it is reasonably necessary for the access to the Websites.

When you access a Website, you agree to do so under the following conditions:
a) you may retrieve,review or download the material only for your personal information or internal business purposes;
b) you may save a local copy of or print out the material for your own personal information but you may not use any material in the Websites for any commercial benefit;

The POAD logo and tagline “Smarter Outdoor” [户外无限度] is a registered trademark of POAD and it may not be used without the prior written permission of POAD. Any other trademarks appearing in the Websites may also not be used without the permission of the trademark owner.

5. Web-based facilities

Your use of or participation in any interactive facility in the Websites or any Social Media Sites constitutes your agreement that you will not:

a) post or transmit any illegal, threatening, abusive, defamatory, obscene, pornographic or indecent information or material of any kind, or encourage any other person to do so;
b) post or transmit any material which violates or infringes the rights of any other person, including privacy, performance, moral, trademark or copyright unless you have obtained the written permission of the relevant right holder;
c) knowingly post or transmit or permit the posting or transmission of any material which contains a computer virus;
d) attempt to exploit the activity for your own commercial purposes or the commercial purposes of any other person, or actually do so (including the posting or transmission of advertising or promotional material), except for legitimate e-commerce functions to be performed by registered users;
e) delete or alter or attempt to delete or alter attributions, legal notices, trademarks or copyright marks on any material contained in the Websites or posted or transmitted on any interactive facility;
f) download or post any material, which you know or ought to know cannot be legally distributed. POAD reserves the right to in its absolute discretion and without assigning any reason therefor and without notice thereof refuse access to any person or edit or delete material posted by any person; or
g) comply with the Terms of any third party website.

Whilst POAD has a right to monitor or supervise interactivity, it has no obligation to do so and accepts no responsibility for the contents therein. By participating in all the web-based activities in the Websites, you grant POAD a perpetual, royalty-free, non-exclusive, unrestricted world-wide licence to use, exploit, copy, sub-licence, re-distribute, adapt, transmit, publish and/or broadcast, publicly perform and display any material placed by you in the Websites.

6. Disclaimer

The materials on POAD Group's web site are provided in an "as is" basis. POAD Group makes no warranties, express or implied, and hereby disclaims and negates all and any warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, POAD Group does not warrant or make any representations concerning the accuracy, likely results, or reliability of the materials in the Websites or otherwise relating to such materials or on any sites linked to this site. Your use of the Websites and all files, documents and programmes in the Websites is at your own risk.

7. Indemnity

You agree to indemnify POAD (including its related bodies corporate and its employees, officers, agents and contractors) from and against all actions, proceedings, suits, claims and demands brought or made against POAD by any person arising out of or incidental to or in connection with or in consequence of any of your act or deed and from and against any damage, loss, cost or expense suffered or incurred by POAD as a result (direct or otherwise) of your breach of the Terms.

8. Revisions and Errata

The materials appearing in the Websites may have technical, typographical, or photographic errors. POAD Group does not warrant that any of the materials in the Websites are accurate, complete, or current. POAD Group may make changes to the materials contained in the Websites site at any time without notice. POAD Group does not, however, make any commitment to update the materials.

9. Governing Law

The Terms is governed by the Laws of Hong Kong. If any provision of the Terms is found to be invalid or unenforceable by a court of law, it shall be severed and will not affect the remainder of the terms and conditions in the Terms, which will continue in full force and effect. All rights not expressly granted herein are reserved.

10. Privacy Policy

Your privacy is very important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.
a) Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.

10.1 Personal Information Collection Statement

POAD is storing this information you have submitted because you have given us your consent to do so on the Websites. The personal data you have submitted are intended solely for POAD (which may disclose such data to its subsidiaries during the handling of this case who are authorised to receive such information relating to law enforcement or prosecution).

10.2 Legal Grounds for Processing Personal Information

a) POAD’s legitimate interests in the effective delivery of information and services to you (see Legitimate Interests for Use below)

10.3 Legitimate Interests for Use

The Websites uses personal information for a number of legitimate interests, including to provide and improve the products and services, administer our relationship with you and POAD’s businesses, for marketing and in order to exercise POAD’s rights and responsibilities. POAD may store and transfer your personal information outside the country you are located. b) Third Party Providers
POAD may transfer or disclose the personal information collect from the Websites to POAD, its subsidiaries and affiliates. POAD transfers personal information for the purposes listed above under Personal Information Collection Statement, for the logistics and maintenance of the Websites. POAD may also transfer personal data to third party service providers (such as website hosting and management and data analysis).

POAD may keep personal information (such as mailing list information) on the systems until a user unsubscribes or requests that we delete that information, given the purposes for while it was collected, or as required by law to do so. The Websites may link to third-party sites that is not controlled and operated under POAD’s privacy practices. Once you link to third-party sites, POAD's privacy practices no longer apply.
